Last week in November the police department conducted a sting operation during a shift change where they guided employees working in the prison system so they could search both them and their vehicles. It is well known that some employees bring inmates items that are both forbidden and illegal. The question is who? Most items are phones, drugs, cigarettes, and alcohol. Phones are especially dangerous as they allow inmates to continue their illegal activities while being locked up.
While I understand the need for this my question is it legal? As an employee do you waive your rights? The 4th Amendment prohibits unreasonable search and seizure. The police can not search a person or their property without a warrant or probable cause, or consent. You also have your Miranda rights, the right to refuse, the right to remain silent, and the right to an attorney if you can not afford one.
Once inside a prison security is tight and employees are checked. And still contraband gets in. A change I would like to see is to get the men out of the women's prison and the women out of the men's prison. A woman working in the men's prison was raped recently and had to be hospitalized. And some of the women inmates have gotten pregnant including Susan Smith.
